1. Introduction

This Terms of Service Agreement (“Agreement”) governs your use of the [CSS Community or any CSS Message Boards] message board (the “Band App”). By accessing or using the message board, you agree to be bound by these terms. If you do not agree to these terms, please do not use the Board.

2. User Conduct

You agree to use the message board following all applicable laws and regulations and in a manner that does not:

  • Violate the rights of others, including intellectual property rights;
  • Harass, threaten, or intimidate others;
  • Promote or encourage illegal or harmful activities;
  • Post spam or unsolicited commercial messages;
  • Disrupt the normal flow of conversation or otherwise interfere with the Board’s functionality;
  • Impersonate any person or entity.

3. Content

  • Ownership: All content posted on the Band App, including text, images, and other materials, is the property of the respective users who posted it.
  • License: By posting content on the Band App, you grant us a non-exclusive, worldwide, royalty-free license to use, reproduce, modify, adapt, publish, perform, and display such content.
  • Removal: We reserve the right to remove or modify any content on the Board, at any time and for any reason.

4. Intellectual Property

The message board and its content are protected by copyright, trademark, and other intellectual property laws. You may not use the CSS Community or its content for any commercial purpose without our prior written consent.

5. Disclaimer of Warranties

THE CSS COmmunity Message Board IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS, WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DISCLAIM ALL WARRANTIES, INCLUDING, BUT NOT LIMITED TO, IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.  

6. Limitation of Liability

IN NO EVENT SHALL WE BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, INCLUDING, BUT NOT LIMITED TO, DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES (EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES), ARISING OUT OF OR IN CONNECTION WITH YOUR USE OF THE BOARD. 

7. Indemnification

You agree to indemnify, defend, and hold us harmless from and against any claims, liabilities, damages, judgments, awards, costs, and expenses (including reasonable attorneys’ fees) arising out of or related to your use of the Board or your violation of this Agreement.

8. Governing Law

This Agreement shall be governed by and construed under the laws of the State of [State], without regard to its conflict of law principles.   

9. Changes to the Agreement

We may update this Agreement from time to time. Your continued use of the Board after any changes are made constitutes your acceptance of those changes.
